The distinction between the two options that we offer is simple. The Living Trust Package is designed for families that (i) own real property or (ii) own other assets with a gross value of $100,000 or more. If you don't own any real estate or you think it is unlikely that you will have $100,000 or more in assets at your death, a will package may be sufficient for your needs. We cannot prepare documents for families with a net worth greater than $2,000,000.
The Living Trust Package is generally the better option because it is designed to help your heirs avoid a costly probate proceeding. The Living Trust Package for married couples also includes language that allows for future estate tax planning flexibility that we do not include in the Will Package.
